The short answer is: maybe. For many who are in default and need to save their home, a Chapter 13 bankruptcy may be used to pay off the arrears over a period of time. However, not everyone may qualify for this particular avenue of bankruptcy. Each case varies on the level of disposable income in relation to the amount of arrears a client may have. Regardless, we can walk you through it and let you know beforehand whether you would or would not qualify.

- Can you guarantee the outcome of my case?
No attorney can guarantee the outcome of your case in any field of law. However, if you do not receive a discharge due to an error by Esquire Law Center, we will refund all of the attorney's fees back. This is our 100% money back guarantee. Very few firms have this guarantee in place.

- Will I lose everything if I file for bankruptcy?
In the vast majority of cases, a bankruptcy filer will NOT lose the vast majority of assets. Most of the cases I see, I'm able to save almost all of a client's assets. This is because in California, you are allowed a $21, 825 wildcard exemption that allows you to protect whatever you choose. Furthermore, there are other exemptions that if applied correctly, would allow you to keep most of your assets. Each case is different, but many people are surprised when they find out they will be able to discharge all of their debt without losing a single dime in assets!

- Will I be able to keep my cars through bankruptcy?
If you are currently financing a car, you can do what's called a reaffirmation agreement with the lender and keep your car. If your car is paid off, you will most likely be able to protect under the vehicle exemption and the wildcard exemption through bankruptcy.

- If I'm married, can I file bankruptcy on my own?
Yes, you can. However, certain debts may still follow your spouse after you file bankruptcy. This area of law can be a little bit tricky so it is best to talk to an experienced attorney about how this could or could not harm you and your spouse.

- How long does the bankruptcy process take?
Filing bankruptcy can be a difficult procedure emotionally and it can take a toll not only on a person, but an entire family. We at Esquire Law Center understand this and therefore work with each and every client to have a timely filing. Generally, once the documents we request for are in, we take no more than week to have your case processed, reviewed, and filed. The vast majority of firms may take anywhere from a month or even longer! Filing for bankruptcy is already tough. There is no need to drag it out and we completely understand this.

- How long will the creditors harass me for?
The moment you retain Esquire Law Center to represent you in bankruptcy proceedings, you are privileged to give our number to any creditor that calls you. You simply tell them that you have retained our firm to represent you in bankruptcy proceedings and that they should cease and desist from calling you. If they persist, we have other measures in place to force them to stop calling you. However, for the most part, this is enough to secure the peace and mind that you have been longing for.

We offer free in person and phone consultations for your convenience. We would like to meet each and every client face to face, but some clients due to medical reasons do not have that option.
